⚖️ NIL Legal News: Key Updates ⚖️
NOCAP Sports Co-Founder and Chief Compliance Officer, Casey Floyd, Esq., brings over a decade of experience navigating NCAA regulations and athlete advocacy, including his role as Director of Compliance at the University of Michigan. With a law degree 🎓 from Washington and Lee University School of Law and a background in business administration, Casey is uniquely positioned to offer expert insights into the ever-changing NIL landscape.
Drawing on his extensive legal expertise 📚 and hands-on experience in compliance, Casey has shared the key takeaways below to help NOCAP partners navigate the latest NIL legal changes effectively.
Here are the latest developments:
New NCAA Rule 22.1.1: Universities can now actively help athletes find NIL opportunities, a major step toward streamlining deals between athletes and brands 🤝.
Expanded Services: Schools can now enlist third-party experts like attorneys and tax professionals 🧑💼 to assist athletes with their NIL contracts and compliance. This is great news for athletes seeking more support as they navigate their NIL deals 💼.
House v NCAA Lawsuit Updates: On September 5th, 2024, attorneys in the House v NCAA lawsuit requested preliminary approval of their settlement agreement. Judge Wilken rejected the agreement, stating it was too unfair to athletes. Both parties now have three weeks to amend the agreement. Key issues highlighted by the judge include restrictive caps on athlete compensation, conflicts of interest with athletes’ attorneys, and the excessive powers granted to the NCAA regarding boosters, collectives, and fair market value payments. As Judge Wilken noted, “taking things away from people is usually not too popular.”
Stay tuned for more updates on how these changes could impact your NIL strategy! 📲
